How to Obtain Environment Clearance License in Bangladesh

Environmental clearance is compulsory for each and every form of industry and project as provided in the Bangladesh Environmental Conservation Act, 1995. No industrial establishment can be undertaken without obtaining an Environmental Clearance Certificate (ECC) from the Department of the Environment (DOE). The industry / project shall meet all the specified requirements set by the Government of Bangladesh with regard to air, noise, water, odor and other environmental quality standards. Such requirements supplement those laid down in the Factories Act 1965, which provides for the regulation of the internal atmosphere of factories and industries.
Types and Categories for Environment Clearance Certificate in Bangladesh
For the purpose of the issuance of the Environmental Clearance Certificate in Bangladesh, industrial units and projects shall be listed in the following four categories or types, taking into account their location and environmental impact one need to find out as to how to obtain the environment clearance certificate, the following category shall shed lights on it.

- Exact description of the raw materials and the manufactured product.
- No objection certificate (NOC) from the local authority.
- A Process Flow diagram.
- A Layout Plan (location of Effluent Treatment Plant).
- Effluent disposal system.
- Other necessary information (if required).
ORANGE B CATEGORY
- A Feasibility Study Report for the proposed industrial unit or project.
- Initial Environmental Examination (IEE) for the proposed industrial unit or project.
- the process flow diagram, Layout Plan (showing location of Effluent Treatment Plant), design.
- An Environmental Management Plan (EMP) Report for the existing industrial unit or project.
- No objection certificate (NOC) from the local authority.
- Outline of the relocation, rehabilitation plan.
- An Emergency plan on pollution minimization and adverse environmental impact.
- Other necessary information (if required).
- A Feasibility Study Report for the proposed industrial unit or project.
- Initial Environmental Examination (IEE) for the proposed industrial unit or project.
- The process flow diagram, Layout Plan (showing location of Effluent Treatment Plant), design.
- An Environmental Management Plan (EMP) Report for the existing industrial unit or project.
- An Impact Assessment Report for the proposed industrial unit or project.
- No objection certificate (NOC) from the local authority.
- Outline of the relocation, rehabilitation plan.
- An Emergency plan on pollution minimization and adverse environmental impact.
- Other necessary information (if required).
Procedure to Obtain Environment Clearance Certificate in Bangldesh
We shall now address the step by step procedure for obtaining environment clearance certificate in Bangladesh.
Step 1 | Fill Up the Prescribed Form
Different industries and factories needs to identify which category they fall in to identify the required form that is needed to be filled.
Step 2 | Arrange the Documents
The respective forms that suits your category shall contain a checklist of the documents required for submitting along with the application. The hierarchy of the arrangement of the documents shall change from time to time, it is better to hire a business lawyer in Bangladesh to stay up to date.
Step 3 | Submit application along with the supporting documents to the Department of the Environment (DOE).
You can submit the application, upon payment of the registration fees mentioned below.
Step 4 | Verification of Application and Supporting Documents by DOE.
The documents needs to be verified by the DOE upon submission of the Documents, it may take a while, in this stage of the process it is important to do a liaison with the Department of Environment.
Step 5 | An Inspection Officer form the department will further inspect after verification of all the documents.
Step 6 | A meeting will be held by Environmental Clearance Committee (only for Orange-B and Red Category).
Step 7 | Decision will be taken at the meeting by the authority.
Step 8 | After all the above steps are complete, if DOE is satisfied then It shall issue an environmental clearance certificate.
Government Fees for Obtaining Environment Clearance Certificate
The Required Fees shall be deposited with the Bank of Bangladesh or the Government of the Treasury Chalan in favor of the Director General.
Depending on the total investment of the project the Government fees are determined. For instance, if the project is between BDT 1 to BDT 50 crore, the estimated fee shall be between BDT 1500 to BDT 50000. If it is more than 50 crores, the estimated fee shall be BDT 100000.
After submission the average processing time for issuing environment clearance license is usually within 1 to 5 months.
Renewal of Environmental Clearance License in Bangladesh
The period of validity in case of Green Category for Environmental Clearance Certificate shall be, three years from the date of its issuance and in all other cases such as Orange A, Orange B and Red shall be one year. Each of the Environmental Clearance Certificate must be renewed at least thirty days before the date of expiry.
